! Comment from our specialist:
Firstly, it’s important to understand that a will is not necessarily a procedure tied to old age or illness. A will is, first and foremost, a guarantee of safeguarding your assets — and everyone who owns any assets in the UAE should have one. Especially if the assets are valuable.

This becomes important because, in the event of unforeseen circumstances, your property would be allocated under the laws of the Muslim world (even if you are a foreigner). Under those laws all your assets must go to the nearest adult male relative, and if none exist — to the state. If you have a will — exclusively to whom you wish.

There are two jurisdictional options for will registration.
- Under Sharia law – suitable primarily for Muslims.
- Under British law – a more familiar form for non-Muslim world representatives. In this case you can bequeath assets, for example, to your wife or sister.“

Frequently Asked Questions about the service

If I already have a will from my country?

It still may be necessary. A will drafted outside the UAE is not always recognised by local courts. In the UAE the local legislation applies, and without a will within the Emirates your property may be distributed under Sharia norms.

What can I include in a will?
  • Real estate
  • Bank accounts, investments, vehicles
  • Business assets and company shares
  • Provisions for children and guardianship
  • Wishes regarding ceremony, charity, etc.
Can I appoint an heir who is not my relative?
Yes. You are free to appoint any person, including a friend, charitable fund or organisation. It is your will.
Can I appoint a guardian for my children in case of my death?
Yes. This is one of the key elements of a will in the UAE. You can designate both a primary and a backup guardian in advance — this protects your children from legal disputes and any uncertainty.
Can a will be contested?
If the will is drafted properly according to all rules, the risk of contesting is minimal. It is extremely important that the document is correctly prepared (which is what we handle).
Do I need to update my will regularly?
Updating a will makes sense when children are born, your family status changes, you acquire new assets (if you want to redistribute them), you change country or Emirate of residence.
Explain more about the difference in jurisdictions
A will drafted via Dubai Courts (Arabic form) is subject to Islamic law: you can allocate only 1/3 of your assets at will, the rest is distributed according to Sharia; the will is made in Arabic, and for non-Muslims does not guarantee full freedom of choice.
By contrast, a will under English law allows expats to fully control the distribution of all assets, appoint any heirs and guardians, is made in English and is governed by secular international law rather than Sharia. We recommend this option for non-Muslims.
